DOT pushes its airline delay-cause rule to Feb. 1, 2027

The U.S. Department of Transportation has delayed the effective date of a rule that sets categories for the causes of airline delays and cancellations. The rule was published in the Federal Register on Sept. 3, 2026 with an effective date of Oct. 19, 2026. A "Delay of Effective Date" notice filed Oct. 14 and published Oct. 15 moves the effective date to Feb. 1, 2027 .

What changed

The notice says reporting changes under the rule apply to flights on or after Jan. 1, 2027. DOT gives the reason as a request from the airline trade group Airlines for America (A4A) for more time to update the Bureau of Transportation Statistics (BTS) reporting directive, industry and BTS systems, and Paperwork Reduction Act approvals . Trade press reported the delay on Oct. 19, which is the date the rule would otherwise have taken effect.

What the rule covers

The original final rule implements Section 511(b) of the FAA Reauthorization Act and lists delay causes treated as outside an airline's control. Examples in the Federal Register text include aircraft damage from extreme weather or sabotage, a compliant response to a cybersecurity attack, unscheduled maintenance that cannot be deferred (including responses to airworthiness directives), removal of an unruly passenger, and airport closures caused by volcanic ash or wind shear .

The documents we opened describe reporting categories. They do not state any new compensation or rebooking entitlement for passengers, and we are not reading one into them.

What to do now

Nothing changes for your next trip because of this notice. The airline's own policy and its contract of carriage still decide rebooking, meals and hotel help after a delay. DOT's consumer pages (transportation.gov/airconsumer) did not show a notice about this delay when we checked (as of Oct 21, 2026; confirm on federalregister.gov and transportation.gov/airconsumer).

The number: Feb. 1, 2027, the new effective date. What to do: Read your airline's delay and cancellation policy before you book a tight connection.
